1. Acceptance of These Terms

By accessing or using The Creative Boutique, creating an account, joining as a creator, publishing a shop or listing, or using any website feature, you agree to these Terms of Use and our Privacy Policy.

Please do not use The Creative Boutique if you do not agree to these terms.

2. About The Creative Boutique

The Creative Boutique is an online creative marketplace and discovery platform. It allows independent creators, makers, and small shops to display shop profiles, listing previews, and links to products offered on their own websites or third-party marketplaces.

The Creative Boutique does not directly sell, license, ship, deliver, fulfill, or process payment for the products displayed in creator listings. This includes physical products, handmade or personalized goods, and digital products. Product purchases take place on external websites selected and operated by each creator. Creator membership fees paid to The Creative Boutique are separate from those external product transactions.

3. Account Eligibility and Responsibility

You must provide accurate information when creating or managing an account. You are responsible for maintaining access to the email account used to sign in and for activity performed through your account.

The Creative Boutique is intended for users who are at least 18 years old or who have reached the legal age required to enter contracts in their location.

You may not impersonate another person or business, create an account using information you are not authorized to use, or attempt to gain unauthorized access to another account.

4. Creator Memberships

Creator and Professional Creator memberships are paid monthly subscriptions unless an account has been granted complimentary access by an administrator.

The membership price and included features are displayed before checkout. By activating a paid membership, you authorize the applicable recurring monthly charge until the membership is canceled.

Membership payments are processed by Stripe. The Creative Boutique does not directly store complete payment-card information.

Paid creators may manage billing information and cancel their membership through the secure Manage Membership option in the Creator Dashboard.

When a membership is scheduled to cancel at the end of the current billing period, membership access normally remains available through the end of that paid period. The subscription will not renew after the scheduled cancellation date.

Canceling a membership does not automatically create a refund for a payment that has already been processed. Please contact us promptly regarding duplicate charges, billing errors, or other billing concerns. Refunds may be provided when required by law or approved under the circumstances of a particular request.

Membership pricing or features may be changed in the future. Changes affecting an existing paid subscription will be communicated as required before they take effect.

5. Membership Access and Visibility

A creator shop must remain approved, active, and membership eligible to appear publicly on The Creative Boutique.

A shop and its listings may become unavailable when a membership expires, payment is not completed, the account is suspended, or the creator no longer meets platform requirements.

Membership does not guarantee sales, website traffic, clicks, followers, revenue, customer inquiries, or featured placement.

6. Creator Responsibilities

Creators are responsible for:

• Providing accurate shop, listing, product, pricing, and contact information.
• Keeping external shop and product links current and functional.
• Owning or having permission to use all submitted images, designs, names, trademarks, descriptions, and other content.
• Clearly explaining product details, formats when applicable, pricing, shipping or delivery terms, licensing terms when applicable, usage restrictions, and customer requirements on the purchasing website.
• Handling shipping or digital delivery, fulfillment, customer service, returns, refunds, taxes, licenses when applicable, and disputes involving their products.
• Following the rules of any external marketplace or website where their products are sold.
• Complying with applicable laws, product-safety requirements, advertising rules, and intellectual-property rights.

7. Purchases from Creators

When a visitor follows a listing link and purchases from a creator's website, Etsy shop, or another marketplace, the transaction is between the visitor and that creator or external marketplace.

The creator is responsible for the product, product description, applicable licensing terms, pricing, payment, shipping or digital delivery, fulfillment, quality, customer service, returns, refunds, and transaction-related disputes.

Questions about a purchased product or item should be directed to the creator or marketplace that processed the purchase.

8. Creator Content

Creators retain ownership of the content they submit to The Creative Boutique.

By submitting shop information, listing images, descriptions, logos, banners, or other materials, the creator grants The Creative Boutique a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, display, and promote that content for operating and marketing the platform.

This permission continues while the content is published and for a reasonable period afterward when needed for backups, legal records, cached pages, or previously created promotional materials.

9. Intellectual Property

The Creative Boutique name, branding, website design, original text, platform features, and other materials created for the website are protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, sell, reverse engineer, scrape, or commercially exploit protected website materials without permission.

Creator names, logos, product images, designs, artwork, and other creator content remain the property of their respective owners.

10. Prohibited Content and Conduct

Users and creators may not use The Creative Boutique to publish, promote, distribute, or link to content that:

• Is illegal, fraudulent, deceptive, or misleading.
• Infringes copyrights, trademarks, publicity rights, privacy rights, or other rights.
• Contains stolen, copied, counterfeit, or unauthorized products, designs, images, or other content.
• Contains malware, harmful code, phishing attempts, or unsafe links.
• Harasses, threatens, exploits, or unlawfully discriminates against another person.
• Includes explicit sexual content, unlawful violence, or other content that The Creative Boutique determines is unsuitable for the platform.
• Manipulates favorites, follows, clicks, listings, or other platform activity.

11. Review, Removal, and Suspension

The Creative Boutique may review creator shops and listings for compliance with these terms and platform guidelines.

We may reject, hide, remove, suspend, or restrict accounts, shops, listings, or links that violate these terms, create legal or security concerns, remain incomplete, or may harm users or the platform.

Serious or repeated violations may result in permanent account removal. Removal for a policy violation does not automatically create a refund for membership fees already charged.

12. Reporting Concerns

Please contact us if you believe a creator shop, listing, image, product link, or other material violates these terms or your intellectual-property rights.

Include enough information for us to identify the material and understand the concern. We may request additional information before taking action.

13. External Websites

The Creative Boutique contains links to creator websites, marketplaces, social-media pages, and other third-party services.

We do not control external websites and are not responsible for their content, availability, privacy practices, security, products, policies, or transactions. Visiting an external website is at your own discretion.

14. Website Availability

We work to keep The Creative Boutique available and functioning, but uninterrupted or error-free operation cannot be guaranteed.

Features may occasionally be unavailable because of maintenance, updates, hosting issues, third-party service interruptions, security concerns, or circumstances outside our control.

15. Disclaimer

The Creative Boutique is provided on an “as available” basis to the extent permitted by law.

We do not guarantee the accuracy, legality, originality, quality, safety, availability, or suitability of creator content, external products, third-party websites, or seller representations.

Visitors should review product descriptions, seller policies, shipping and return terms, licenses when applicable, and marketplace terms before completing an external purchase.

16. Limitation of Liability

To the fullest extent permitted by applicable law, The Creative Boutique and its owner will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, creator content, external websites, membership interruptions, or transactions between creators and customers.

Nothing in these terms excludes rights or responsibilities that cannot legally be excluded or limited.

17. Changes to These Terms

We may update these Terms of Use when website features, business practices, or legal requirements change.

The updated date at the top of this page will show when the terms were most recently revised. Continued use of the website after updated terms become effective indicates acceptance of those updated terms.
